The long and Muddy Journey

Hi folks!!!!


As some of you now know, my arduous tenure as the VP of Big Horn Ranch HOA has finally come to an end.

That being said, I can finally speak freely about the going's on within the ranch.

1. The roads within the Ranch are in the worst shape I have seen in the last 5 years.

2. The work on the 1st mile of road (which the company doing the road has already been paid for) is nowhere near done and is actually contributing to the further deterioration of the roads.

3. The "culverts" that the homeowners paid for are not only not functional, they are actually HOLDING water.

4. The company hired to "plow" the roads is still doing so at their own discretion and is still using a backhoe to do the work despite being told several times not to do so.

5. As a result of #4 almost all of the packing of the material used to "build up" the 1st mile of road will now need to be re-done.

The owner of that company is driving around in a brand new shiny truck!!!!!!!!!!!! (kinda poor form, considering you are still nowhere near completing the job you were PAID to do!!!)

Hi JP! Cute blog name....I think initiation to BHR is sliding down the first hill (inside the gates) sideways in your 4WD jeep because the tires are covered with wet clay. Always gets the blood pumping.

I hired Carl to doze in the road to Lot 2, he did a great job for a great price. I know a number of lot owners are using him now. I'm trying to get down there now every week or so.

Yup, the main roads are pretty bad....my understanding from reading the CCIOA (CO State Law governing HOAs) the settlement amount isn't at the boards discretion as it would be a surplus fund, which isn't addressed in our by-laws that I can find. Technically it has to be treated as a pre-payment of HOA dues, but I think we would all agree to fix the roads first. However, the use of it needs to be voted on by the association members with appropriate documentation provided (itemized bids). That would be the logical and appropriate steps to take.

My understanding is, correct me if I'm wrong.....the work was assigned with no competing bids solicited so we don't know if the costs were in line. A $28,000 check was written before the work was performed, with no contract in place with the contractor(required under CCIOA)from a surplus fund. And it was $28,000 for only 1 mile of road???

It seems to me the bids for road work last year were something like $12-14k for all 13 miles of roads. Is a lot more work being performed?????

While I don't think anyone would disagree with the need to fix the roads, I would think we would all like to have bids taken so we would know that the costs were inline. I can guarantee you if I'm going to spend $28,000 of my money on a repair....I'm going to get more than one estimate. I can see paying for materials ahead of time, but not labor. I would never write a $28,000 check without a contract in place and receiving no estimates in case the work was not performed or performed satisfactorily. All of this is just basic good business sense.

The $120,000 gross settlement (not sure what net was) doesn't belong to the board to use for whatever they want. It belongs to every single member of the HOA and they absolutely have the legal right to have a voice in how it's spent to repair the roads.

If I'm incorrect in facts, someone please correct me....the rest is just my 2 cents as a concerned owner of 2 lots in BHR and former board member.

Thanks for the time you tried to help the HOA JP. I know it's not easy...been there, done that.

Being neighborly is one thing, but an HOA is a business and is governed by state laws for a reason. And if they don't like the state laws, well they can write their congressman and change them...but until that time they have to comply.
